LEGATO v. NSI

This is not a technical question but it has implications on technical work I’ve been doing on a file systems filter driver. I was hoping to get feedback regarding the lawsuit filed by LEGATO against NSI. Does LEGATO have a case? Will this mean no one can write a commercial file systems filter driver that replicates?

As Linus has said (and as per the advice I’ve been given many times), as
software engineers the best thing we can do in regards to software
patents is not to research them. There are so many software patents out
there virtually anything you do can be construed to infringe on
something. If you willingly infringe, damages are treble, so therefore
it’s in your best interest not to even know about these patents.

cautious about any statements they make on this topic. If you’re on this
list you’re probably considered a “subject matter expert” and thus can be
held accountable for your publically stated opinions. People HAVE been
successfully sued in the states for forum postings that give disparaging
opinions (as in “that is soooo stupid!”) in areas where they are considered
subject matter experts.

What patent?

It makes me sick! If you can’t beat them, sue them; the new motto for
sinking companies. They should all be hung by their short hairs and left
to rot on the pole.

That is why shysters get $400 to $1000 per hour. Even with that, it is
probably cheaper to pay one of them to answer your questions before you
spend tens of thousands of dollars in development costs. Even if it is only
a one person development, you will loose any income that could have been
gained pursuing something that can be sold or a contract that pays.

This only protects you if someone else tries to patent the idea; you can
prove prior art, but that is worthless. It does not give you any rights
of a patent holder.

Remember in patent disputes the only winners are the shysters - both
sides. Even in bankruptcy, the shyster judges always protect other
shysters first. Shareholders, debtors, etc. last if the shysters
couldn’t get their hands on everything. I think that judges should not
be shysters - too much of a conflict of interest in civil cases. If it
didn’t pay so well, you wouldn’t have all the TV commercials trying to
get clients for them.

The Legato patent is dated June 1995. Does anybody know of any prior art with regards to file systems filter drivers that replicate blocks, irrespective of operating system (since the patent doesn’t specify it)?

I would bet that DEC has patents in that area for work they developed for

Jeez guys… I would like to restate that it’s in our best interests not
to research this issue at all and especially not to post the results of
any such research conducted. If somebody finds some patent from long ago
relating to the work of some subset of the readers on this list, and
posts information about it, then all list readers who are a member of
this subset become willful infringers. At least that’s how I understand
the situation.

Well, when I worked on them, VAXClusters didn’t do replication. They used
shared storage for the most part. Although I suppose they did do some kind
of proxy I/O for nodes that weren’t connected to the shared storage.
